Terms of Service

Effective date: 2026-07-29. These Terms of Service (the "Terms") are a binding agreement between you and Funkihoo LLC, a New Jersey limited liability company ("funkihoo," "we," "us," or "our"). By creating an account, accessing, or using funkihoo, you agree to be bound by these Terms and by our Privacy Policy, Community Guidelines, Refund Policy, and Cookie Policy, each incorporated by reference. If you do not agree, do not create an account and do not use the service.

1. About funkihoo

funkihoo is a Muslim matrimonial platform intended for adults seeking marriage. The service includes profile creation, algorithmic match ranking, mutual-consent introductions, private one-to-one messaging between matched users, optional wali (guardian) involvement workflows, and paid features such as subscription tiers and introduction credits. The service is offered through the website at funkihoo.com and, when made available, through native mobile applications distributed by the Apple App Store and Google Play.

funkihoo is not a casual dating service, a hookup platform, or an escort service. Behavior inconsistent with matrimonial intent is a violation of these Terms and is enforced through the mechanisms described in §11 and §12.

2. Eligibility

You may create an account and use funkihoo only if you meet all of the following:

  • You are at least 18 years old.
  • You have full legal capacity to enter into a binding agreement in your jurisdiction of residence.
  • You are not located in, under the control of, or a national or resident of any country subject to a comprehensive U.S. embargo, and you are not on any U.S. or applicable foreign government list of restricted or prohibited parties (including OFAC's SDN list).
  • You have not been previously banned from funkihoo, unless we have granted you an express reinstatement.

We verify your date of birth at signup and reject accounts whose declared date of birth indicates the person is under 18. Misrepresenting your age is a material violation of these Terms and grounds for permanent removal without refund.

3. Account creation and security

  • You may hold only one active funkihoo account.
  • You must provide accurate, current, and complete information during registration and keep your profile accurate over time. Certain fields — including gender and date of birth — cannot be changed by you after signup; you may request administrator correction within 30 days of signup with documentary evidence.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@funkihoo.com if you suspect unauthorized access.
  • You may pause your account at any time from Settings; a paused account is invisible to other users and does not consume features. You may resume with no data loss.
  • You may delete your account at any time from Settings. Deletion begins a 30-day grace window during which you may restore. After the grace window, your personal data is purged from our production systems in accordance with our Privacy Policy and applicable law.

4. Verification

To help ensure trust and safety on the platform, funkihoo applies the following verification measures. Verification does not guarantee that any user is who they claim to be, but it materially raises the cost of bad-faith activity.

  • Email verification. Every account is bound to a verified email address.
  • Phone verification. Every account is bound to a verified phone number delivered via SMS one-time passcode.
  • Liveness selfie. Users are required to complete a real-time selfie capture, which is compared against uploaded profile photos to detect impersonation. The liveness capture is not used for facial recognition beyond this comparison and is retained only for the period needed to complete the check.

5. Photos and the blur-until-match invariant

You retain ownership of the photos you upload. By uploading, you grant funkihoo a worldwide, royalty-free, non-exclusive, sublicensable license to store, transmit, and display those photos to other users in furtherance of the service, subject to your privacy settings.

By default, profile photos are blurred to non-matched viewers. Photos become clear only after two users have mutually matched (or, at the uploader's option, when the uploader disables the blur setting). This invariant is enforced server-side; no client-side toggle can bypass it. You may replace or delete your photos at any time; deletion removes them from future serving within minutes and from backups within our documented retention window.

6. Introductions, connections, and messaging

funkihoo distinguishes between discovery (browsing suggested matches and expressing interest through "likes") and introductions (opening a new one-to-one communication channel with another user).

  • Likes are lightweight signals of interest. Every user receives a daily free allocation of likes based on their subscription tier; additional likes may be purchased through like credit packs.
  • Introductions open a new communication channel with a specific user by sending a first message. Sending an introduction consumes one introduction credit. Every user receives a daily free allocation of introductions based on their subscription tier; additional introductions may be purchased through introduction credit packs. Once the recipient accepts the introduction, the two users are connected and may exchange unlimited messages within that connection at no additional cost.
  • Messaging within a connection is unlimited and included. funkihoo does not charge per message and does not gate the messaging feature behind credits or subscriptions after a connection is established.
  • Introduction credits are not refundable except as expressly set out in our Refund Policy. Introduction credits have no cash value and are not transferable between accounts.

7. Subscriptions and payments

funkihoo offers optional paid subscription tiers (currently "Silver" and "Gold") in addition to the free "Basic" tier. Every tier includes every feature; paid tiers increase the daily free allocations for likes and introductions and remove third-party advertising. Subscriptions renew automatically on the interval you selected (monthly, six-monthly, or yearly) at the price displayed at the time of purchase, until you cancel.

Payments made through funkihoo.com are processed by Stripe, Inc. Payments made through the Apple App Store or Google Play are processed under Apple's or Google's respective terms and are subject to their billing rules; for those channels you must manage subscriptions (including cancellation) through the App Store or Google Play account settings.

Prices are displayed inclusive of applicable taxes where required by law. Your billing currency is determined by your country of residence at signup and, once locked, may be changed only through the administrator-mediated reset process described in the Account Settings.

You may cancel a web-billed subscription at any time from your account settings; the cancellation takes effect at the end of the current billing period, and you retain access to paid features until that end date. Refund requests are handled per our Refund Policy.

8. Content ownership and license

You retain ownership of the content you post to funkihoo, including your profile information, photos, and messages ("User Content"). By posting User Content, you grant funkihoo a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to host, store, transmit, display, modify (for formatting purposes), and distribute your User Content solely to operate and improve the service and to enforce these Terms. This license terminates when you delete the content or your account, except that (a) residual copies may persist in encrypted backups for up to 90 days, and (b) we may retain and use User Content as necessary to comply with legal obligations or to enforce these Terms or the Community Guidelines.

You represent and warrant that you own or have the necessary rights and consents to post each item of User Content, and that your User Content does not infringe or violate any third-party right (including intellectual property, privacy, or publicity rights).

9. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy and, where applicable, by regional addenda (see §21). Please review these documents carefully.

10. Community Guidelines

Your use of funkihoo is also governed by our Community Guidelines, which describe expected behavior on the platform and specific content restrictions in matrimonial context. The Guidelines are enforceable as part of these Terms.

11. Prohibited conduct

The following are strictly prohibited on funkihoo. Violation results in immediate, permanent removal of the account, forfeiture of any unused paid balances (subject to applicable consumer-protection law), and, where applicable, referral to law enforcement.

  • Human trafficking, including sexual exploitation. funkihoo may not be used to recruit, transport, harbor, or receive any person for the purpose of exploitation — including but not limited to sexual exploitation, forced labor, servitude, debt bondage, or slavery. Any suspected use of the platform to facilitate human trafficking is reported to the National Human Trafficking Hotline (United States: 1-888-373-7888) and, where jurisdictionally applicable, to local law enforcement.
  • Aiding, abetting, or encouraging abuse. You may not use funkihoo to harass, threaten, intimidate, stalk, defraud, extort, blackmail, or otherwise abuse another user, and you may not aid, abet, encourage, or induce any other person to do so. This includes sending unsolicited sexual or explicit content, coordinating off-platform meetings with intent to harm, doxxing, sharing another user's private content without consent, or coordinating group harassment.
  • Child Sexual Abuse Material (CSAM), child sexual exploitation, and solicitation or targeting of minors. funkihoo strictly prohibits Child Sexual Abuse Material (CSAM), child sexual exploitation in any form, and any attempt to contact, groom, solicit, target, or facilitate contact with a person under 18 — whether on or off the platform. The 18+ eligibility rule is absolute. These are zero-tolerance violations, are referred to law enforcement, and are reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline under 18 U.S.C. § 2258A.
  • Commercial solicitation. You may not use funkihoo to sell goods or services, promote external businesses or platforms, solicit escort work or other transactional sexual services, run affiliate marketing, promote multi-level-marketing schemes, or arrange transactional relationships of any kind.
  • Impersonation and misrepresentation. You may not impersonate another real person, use another person's photos or identifying information without their consent, misrepresent your marital status or eligibility to marry, misrepresent your age or gender, or otherwise deceive other users about your identity or circumstances.
  • Off-platform contact evasion. You may not solicit contact information (phone, email, external messaging handles, social media identities, payment addresses) in your profile, in first messages, or otherwise before an introduction is accepted and an established connection exists. This rule exists to protect users from off-platform scams and abuse.
  • Payment fraud and chargeback abuse. You may not use stolen payment instruments, misuse chargeback processes, or otherwise engage in payment fraud. We may refuse service, freeze balances, and refer to law enforcement in cases of suspected fraud.
  • Automated access. You may not scrape, crawl, harvest, or otherwise extract data from funkihoo through automated means without express written permission. You may not use funkihoo to train machine learning models or datasets.
  • Interference with the service. You may not attempt to circumvent our rate limits, security controls, or moderation systems; reverse-engineer or decompile the service; introduce malware; or otherwise materially interfere with funkihoo's operation or with other users' use of the service.
  • Unlawful content or use. You may not use funkihoo for any purpose prohibited by applicable law or to post content that is illegal, defamatory, obscene, hateful, or that infringes any third party's rights.

We cooperate fully with law enforcement investigations and will respond to lawful process as described in §20.

12. Reporting and moderation

You may report other users, messages, photos, or profiles that you believe violate these Terms or our Community Guidelines through the in-app report flow, or by emailing trust@funkihoo.com. Reports are reviewed by our Trust & Safety team; we may take action ranging from a warning, temporary suspension, content removal, permanent removal, to law-enforcement referral, depending on the severity of the violation.

Blocking another user creates a total bidirectional isolation: the blocked user cannot see your profile, your photos, or contact you, and you cannot see theirs. Existing chats are dissolved on block.

13. Termination and appeals

We may suspend or terminate your account, with or without notice, if we have a good-faith belief that you have violated these Terms, the Community Guidelines, or applicable law, or if continued provision of the service to you creates an unacceptable risk to other users or to funkihoo. On termination, your license to use the service ends immediately.

You may appeal a ban through the appeal process available at funkihoo.com/app/account/appeal, which we commit to review within seven (7) business days. Repeated or egregious violations may not be appealable.

14. Intellectual property; DMCA

funkihoo and all associated names, logos, and trademarks are the property of Funkihoo LLC. The service, including all software, designs, and non-user-generated content, is protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works based on the service except as expressly permitted.

If you believe content on funkihoo infringes your copyright, please send a notice containing the elements required by 17 U.S.C. § 512(c)(3) to our designated agent at dmca@funkihoo.com. Postal address: Funkihoo LLC, Attn: DMCA Agent, 59 Buttonwood Drive, East Brunswick, NJ 08816, United States. We will respond to properly submitted notices in accordance with the Digital Millennium Copyright Act.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATION OR WARRANTY THAT YOU WILL FIND A MATCH, THAT ANY OTHER USER'S REPRESENTATIONS ARE ACCURATE, OR THAT ANY INTRODUCTION WILL RESULT IN A RELATIONSHIP. YOU ASSUME ALL RISK ASSOCIATED WITH INTERACTIONS ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY OFFLINE MEETINGS YOU CHOOSE TO ARRANGE. WE STRONGLY RECOMMEND YOU FOLLOW THE SAFETY GUIDANCE PUBLISHED IN OUR SAFETY CENTER AT funkihoo.com/safety.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUNKIHOO LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNKIHOO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FUNKIHOO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Funkihoo LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (i) your access to or use of the service, (ii) your violation of these Terms or the Community Guidelines, (iii) your User Content, or (iv) your violation of any third-party right, including any intellectual property, publicity, or privacy right.

18. Dispute resolution and arbitration

Informal resolution first. Before initiating any formal dispute resolution, you agree to first contact us at legal@funkihoo.com and attempt to resolve the dispute informally. We commit to good-faith engagement for at least thirty (30) days before either party may initiate a formal proceeding.

Binding arbitration. If informal resolution does not succeed, you and funkihoo agree that all disputes arising out of or relating to these Terms or the service will be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. The seat of arbitration will be Middlesex County, New Jersey, United States, or via videoconference at the arbitrator's discretion. Judgment on any arbitral award may be entered in any court of competent jurisdiction.

Class action waiver. You and funkihoo each agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and funkihoo each waive the right to a jury trial.

Small claims exception. Either party may bring an individual action in small-claims court in lieu of arbitration for disputes within that court's jurisdiction.

Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@funkihoo.com within thirty (30) days of first accepting these Terms. The notice must include your full name, the email address associated with your account, and an unambiguous statement that you decline arbitration.

19. Governing law

These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. This choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence where those provisions apply notwithstanding a choice-of-law clause.

20. Law enforcement and government requests

funkihoo cooperates with valid law enforcement requests. Requests should be directed to legal@funkihoo.com and should include the requesting agency, the specific user account or transaction at issue, and the legal basis for the request (subpoena, court order, search warrant, MLAT request, etc.). Absent an emergency or a legal prohibition on disclosure, we notify affected users of requests for their data before responding.

In genuine emergencies involving imminent risk of death or serious physical injury, we may disclose account information without prior notice or process; qualifying agencies may submit emergency requests to the same address, marked "EMERGENCY DISCLOSURE REQUEST."

21. Regional addenda

The following addenda are incorporated into these Terms for users in the respective jurisdictions and prevail over any conflicting provision above to the extent required by local law:

  • European Union and United Kingdom addendum — including GDPR and UK GDPR rights, EU DSA reporting, and consumer rights under the EU Consumer Rights Directive.
  • Türkiye addendum — including KVKK (Kişisel Verilerin Korunması Kanunu) rights and Turkish consumer protection law.
  • India addendum — including rights under the Digital Personal Data Protection Act, 2023 (DPDP), and Consumer Protection Act, 2019.
  • California addendum — including CCPA/CPRA rights for California residents.

22. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least thirty (30) days before the changes take effect by (a) posting the updated Terms with a new Effective date at funkihoo.com/legal/terms, and (b) sending an in-app banner and an email to the address associated with your account. Changes that are immaterial or that expand your rights may take effect on posting. Your continued use of the service after the Effective date of an update constitutes acceptance of the updated Terms. If you do not accept an update, your remedy is to stop using the service and delete your account before the update takes effect.

23. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, Community Guidelines, Refund Policy, Cookie Policy, and any applicable regional addendum, constitute the entire agreement between you and funkihoo concerning the service and supersede any prior agreement.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
  • Notices to funkihoo must be sent to legal@funkihoo.com with a physical copy to: Funkihoo LLC, 59 Buttonwood Drive, East Brunswick, NJ 08816, United States.
  • Notices to you will be sent to the email address associated with your account or posted as an in-app notice, at our option.
  • Relationship. Nothing in these Terms creates any joint venture, partnership, employment, or agency relationship between you and funkihoo.
  • Force majeure. Neither party is liable for any failure to perform due to causes beyond its reasonable control, including acts of God, natural disasters, government actions, war, terrorism, labor disputes, or failures of infrastructure or third-party services.
